Co-habitation
It is quite common nowadays for people to live together who are unmarried. It is rarely realised though that the legal consequences of cohabitation can be far reaching.
If faced with a crisis, usually in the form of death or relationship breakdown, cohabitants can make very little use of the system of law available in England and Wales to married people. Whereas the courts have powers to adjust property rights on divorce or death, they can only determine the property rights of cohabitants by reference to deeds, documents and agreements. If these are not available, the courts have to consider actual contributions by the parties and/or their intentions. It may be difficult to prove actual contributions because the parties may have forgotten, and as for the parties original intentions, these may not be readily identifiable, or could be disputed.
We advise people who are unmarried couples to have a cohabitation agreement to record their intentions and ownership of assets by reference to their contribution. This ensures that any disagreements on separation can be minimised and risks of litigation in the courts reduced.
